Senior Legal Counsel

IO’s Transaction Services and Corporate Legal Enterprise Team provides professional support to all parts of the agency. Lawyers within the team specialize in services that support infrastructure and commercial projects, construction, real estate and leasing, lending, privacy protection, government affairs, litigation, and contract management.

Position Purpose:

The purpose of this role is to work closely with IO project teams and our public sector partners to keep projects on track by preventing, mitigating, managing, and settling contentious disputes with our contractual counterparties on Ontario’s most interesting P3 and other public projects.

What You Will Do:

• Act to the high ethical and professional standards in all dealings with IO personnel and other stakeholders;
• Provide actionable legal advice to all levels of the organization;
• Analyze complex and unique facts and circumstances to resolve claims and disputes on their merits;
• Identify optimal combinations of process improvements and legal strategies to improve project safety, budget, quality, and schedule outcomes;
• Act as subject matter expert within IO Legal in respect of matters (e.g. contractual exercise of discretion and application of standards of “reasonableness” and contractual good faith, litigation and settlement privilege);
• Undertake ongoing continuous improvement initiatives (including P3 Project Agreement amendments and Project Delivery practices and procedures) based on lessons learned from near misses, early warnings, claims, and disputes;
• Perform legal research; draft and review correspondence, triage reports, and others documentation in respect of early warnings, claims, and disputes in accordance with applicable Notice Management Procedures;

Who We’re Looking For:

• Membership in good standing with the Law Society of Ontario
• 3 - 6 years’ experience in construction law, dispute resolution, or troubled project repair
• University degree in Law (LLB or JD)
• The ability to:
• Express yourself verbally and in writing with great clarity and precision;
• Adjust your communication style to the needs of the audience in the context of the decision to be taken or objective to be achieved;
• Persuade (or be persuaded by a convincing argument).
• An inherently curious individual who enjoys solving a puzzle and understands the high legal and business stakes involved in timely and effective resolution of issues
• An open mind: You excel at challenging your own assumptions and those of others
